These Terms of Use ("Terms") govern your access to and use of OnBackend at onbackend.com (the "Service"), operated by OnBackend ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of the Service

OnBackend is a form backend-as-a-service platform. You create API keys, integrate them into your HTML forms, and we capture form submissions, store the data, and send you email notifications. The Service is designed for developers, businesses, and individuals who need a simple backend for static website forms.

2. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent that you meet this requirement. If you are using the Service on behalf of a business, you represent that you have the authority to bind that entity to these Terms.

3. Account responsibility

You are responsible for maintaining the security of your API keys and account access. Do not share your API keys publicly in a way that allows others to impersonate your forms. You are responsible for all activity that occurs under your account, including form submissions received through your API keys.

4. Acceptable use

You agree not to use the Service to:

  • Collect data for unlawful purposes or in violation of applicable laws
  • Send spam, phishing content, or unsolicited communications
  • Collect sensitive personal information (financial data, health records, government IDs) without appropriate safeguards and legal basis
  • Attempt to reverse-engineer, disassemble, or interfere with the Service
  • Overload the Service through automated or excessive requests beyond rate limits
  • Use the Service to facilitate harassment, abuse, or illegal activity

We reserve the right to suspend or terminate access for any user who violates these Terms, without notice.

5. Data you collect

You are the data controller for the form submission data collected through your forms. You are solely responsible for:

  • Ensuring your forms comply with applicable privacy laws (GDPR, CCPA, etc.)
  • Providing appropriate privacy notices to your form visitors
  • Obtaining any necessary consent for data collection
  • Handling data subject requests (access, deletion, etc.)

OnBackend acts as a data processor on your behalf, processing form submissions as instructed by your form configuration.

6. Limits

OnBackend is free. Each account includes up to 5 forms, 500 submissions per form per month, and 90-day data retention. We reserve the right to modify these limits at any time. Submissions exceeding the rate limits will be rejected with a 429 status code.

7. Intellectual property

The Service, including its design, code, and branding, is owned by OnBackend and protected by applicable intellectual property laws. The data you collect through your forms remains yours — we do not claim ownership over your submission data.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that email notifications will always be delivered. We do not guarantee that form submissions will never be lost.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ONBACKEND SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US FOR THE SERVICE (WHICH, ON THE FREE TIER, IS ZERO).

10. Indemnification

You agree to indemnify and hold harmless OnBackend from any claims, liabilities, damages, and expenses arising from: (a) your use of the Service; (b) the data you collect through your forms; (c) your violation of these Terms; or (d) your violation of any third party's rights or applicable laws.

11. Service modifications and termination

We reserve the right to modify, suspend, or discontinue the Service at any time, with or without notice. We may modify these Terms at any time by updating the "Last updated" date. Your continued use constitutes acceptance of the updated Terms.

12. Governing law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which OnBackend operates, without regard to conflict of law principles.

13. Severability

If any provision of these Terms is found unenforceable, that provision shall be limited to the minimum extent necessary, and the remaining provisions remain in full effect.
